Deangelo allegedly sold illegal items to undercover state trooper

The owner of a CBD store in Hollidaysburg faces charges after allegedly selling illegal products to an undercover state police officer.

Michael Joseph Deangelo, 57, of Altoona, was arraigned Tuesday before Magisterial District Judge Paula M. Aigner on two felony charges of possession with intent to deliver and two misdemeanor charges of possession of a small amount of marijuana. He was released on unsecured $50,000 bail and has a preliminary hearing set for Aug. 15 before Aigner.

According to the affidavit of probable cause, on Jan. 18, an undercover officer entered the Innovative Extracts/Our CBD Store on the 200 block of Allegheny Street in Hollidaysburg Borough and noticed a jar labeled Delta-8 Boom Gummies 500 mg, 25 mg Delta 8 per gummy. The officer reported that if the label was correct, the item is illegal in Pennsylvania.

The officer picked up that item for purchase and noticed a Delta 8 vape cartridge. As he picked it up to look at it closer, another product fell to the floor. When he picked up that item, Deangelo said it was really good, explaining the item, a Boom Sticks Designer Edition Peaches and Cream Delta 8 disposable vape, was for the experienced user and would give an intense high.

Deangelo said the jar of gummies would give the casual user a more mellow high, the report states.

The officer then purchased the two items, using confidential state funds. The total was $65, but when Deangelo saw he was going to pay in cash, said he would keep the sale out of the register and knock off the tax. The officer paid $60 and left the store with the items in a bag marked with Your CBD store and a referral form advising that he would receive a free gift for referring a new customer, court documents state.

On May 24, the undercover officer again entered the store, where Deangelo pointed out several jars of a new strain of marijuana “buds.”

Court documents state that after the officer briefly looked around, he asked for more products like the peaches and cream vape purchased previously. He was told the state changed the law and Delta 8 was now illegal.

The officer then told Deangelo he was looking for a good psychological high, to which Deangelo pointed out two items, the report states. The first was a vape cartridge that Deangelo said was made with a different process versus the Delta 8. That process made it legal in the state. Deangelo then picked up a jar of gummies labeled with the symbol for Delta 8 and the letters THC.

The product in the jar was a hashish product made in house at their establishment in Johnstown, Deangelo said, adding it was a very strong product and should only be purchased by experienced smokers.

The undercover officer purchased both products with confidential state funds. The items were put in a bag with a Your CBD sticker, with Deangelo advising that this would keep it legal if the buyer encountered police while in possession of the products, the report states.
